Terms and Conditions – Cigar Hut


1. Introduction and acceptance of terms
1.1 These Terms and Conditions govern your use of the website cigarhut.com.au and any purchases made through it (Site). By accessing the Site or placing an order, you agree to be bound by these Terms and Conditions.

1.2 The Site is operated by Cigar Hut, ABN 13 119 643 757, located in Castle Hill, New South Wales, Australia (we, us, our).

1.3 If you do not agree to these Terms and Conditions, you must not use the Site or purchase products from us.

2. Eligibility and age restrictions
2.1 Our products are tobacco products and are intended only for adults aged 18 years and over.

2.2 By using the Site and placing an order, you warrant that you are at least 18 years old and legally entitled to purchase tobacco products in Australia.

2.3 We may require satisfactory proof of age (such as a government‑issued photo ID) and reserve the right to cancel any order where age verification cannot be completed to our satisfaction.

3. Australian territory and jurisdiction
3.1 We only sell and ship products to addresses located within Australia. Orders with delivery addresses outside Australia will not be accepted.

3.2 These Terms and Conditions are governed by the laws of New South Wales and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.

4. Orders and accounts
4.1 You may place orders as a guest or by creating an account on the Site. You must ensure that all information you provide is accurate, current and complete.

4.2 When you place an order, you are making an offer to purchase the products at the prices and on the terms stated on the Site. We may accept or reject your order for any reason, including product availability, suspected fraud, or failure to meet our eligibility requirements.

4.3 An order is accepted when we issue an order confirmation and/or dispatch notification. Title in the products passes to you upon receipt of payment in full.

4.4 If we cancel an order after payment has been processed, we will refund any amounts received to your original payment method, subject to any banking or payment‑gateway processing times.

5. Pricing, payment and GST
5.1 All prices are listed in Australian dollars (AUD) and include GST where applicable, unless otherwise stated.

5.2 We may change prices at any time without notice, but changes will not affect orders already accepted by us.

5.3 Payment must be made using the methods offered at checkout (for example, credit card or other payment services). You authorise us to charge your selected payment method for the total order amount, including applicable taxes and shipping.

5.4 Credit card information is processed by our payment provider (currently ANZ eGate Merchant Services) over a secure, encrypted connection and is not stored by Cigar Hut.

6. Shipping, delivery and risk
6.1 Orders are generally shipped within two working days via Parcel Post or Express Post, as set out on our Shipping & Returns page.

6.2 If you have not received an order within the timeframe indicated on the Site or your dispatch email, please notify us by email at orders@cigarhut.com.au.

6.3 Risk in the products passes to you when the order is delivered to the address you provide, or when delivery is otherwise completed according to the carrier’s records.

6.4 We are not liable for delays caused by carriers, public holidays, customs inspections or other events beyond our reasonable control.

6.5 Where required or appropriate, we may instruct carriers to obtain a signature and/or check ID upon delivery to confirm age. Failure to provide satisfactory ID may result in the goods being returned to us and the order being cancelled, subject to any reasonable return or restocking fees.

7. Returns, refunds and cancellations
7.1 Our Shipping & Returns policy forms part of these Terms and Conditions and is available on the Site.

7.2 All returns must follow the process described on the Shipping & Returns page, including contacting us at orders@cigarhut.com.au and providing the requested information.

7.3 Due to the nature of tobacco products, we generally do not accept returns for change of mind once a product has been dispatched, except as required under the Australian Consumer Law (ACL).

7.4 If a product is faulty, damaged on arrival, or mis‑described, please contact us within a reasonable time with details and supporting evidence (such as photos). Where required under the ACL, we will offer a repair, replacement or refund.

7.5 To the extent permitted by law, products that have been opened, used, stored improperly or damaged after delivery are not eligible for return or refund, unless the issue arises from a defect covered by the ACL.

7.6 You may request cancellation of an order prior to dispatch. We will use reasonable efforts to process cancellations but cannot guarantee that an order can be stopped once confirmed. If cancellation is accepted, we will refund any amounts paid, less any non‑recoverable transaction fees where permitted by law.

8. Product information and use
8.1 We take care to ensure that product descriptions, images and specifications on the Site are accurate and up‑to‑date, but minor variations in colour, dimensions, bands or packaging may occur.

8.2 All flavour notes, strength indicators and tasting descriptions are subjective and provided for general guidance only; individual experience may differ.

8.3 Products are sold for personal use only and are not intended for resale. We may cancel orders which we reasonably suspect are for unauthorised resale.

8.4 Tobacco products contain nicotine, which is an addictive substance. Smoking can cause serious health issues, including cancer, heart disease and respiratory illness. By purchasing our products, you acknowledge these risks and accept responsibility for their use.

9. Use of the Site and prohibited conduct
9.1 You must not use the Site for any unlawful purpose, to infringe the rights of others, or in any way that could damage, disable or overburden our systems.

9.2 Without our prior written consent, you must not:

scrape, harvest or otherwise collect data from the Site by automated means

reproduce, distribute or publicly display any part of the Site, other than for your personal, non‑commercial use

attempt to gain unauthorised access to our systems or user accounts.

9.3 We may suspend or terminate your access to the Site if we reasonably believe you have breached these Terms and Conditions or applicable law.

10. Intellectual property
10.1 All content on the Site, including text, images, graphics, logos, trademarks, layout and software, is owned by Cigar Hut or its licensors and is protected by Australian and international intellectual property laws.

10.2 You are granted a limited, non‑exclusive, revocable licence to access and use the Site for personal, non‑commercial purposes. You must not reproduce, modify or create derivative works from the Site content without our prior written consent.

11. Privacy and consumer data
11.1 Our Privacy Policy and Consumer Data Policy form part of these Terms and Conditions and are available on the Site.

11.2 By using the Site, you consent to the collection, use and disclosure of your personal information as described in the Privacy Policy and Consumer Data Policy, including for order processing, customer support, analytics and marketing (where permitted).

11.3 We store and handle personal information for accounting and operational reasons and do not sell your information to third parties. Third‑party service providers (such as carriers and payment gateways) may receive limited data only as required to perform their services.

11.4 Credit card details are transmitted directly to our payment gateway service over an encrypted SSL connection and are not processed on our servers or stored by us.

12. Disclaimers and limitation of liability
12.1 To the maximum extent permitted by law, the Site and products are provided “as is” and “as available”, without any express warranties, other than those required by the ACL.

12.2 Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the ACL or any other law that cannot lawfully be excluded.

12.3 To the extent permitted by law, our liability for any claim arising out of or in connection with these Terms and Conditions, the Site or any products is limited, at our option, to:

re‑supplying the products or services; or

refunding the amount you paid for the relevant products or services.

12.4 We are not liable for any indirect, consequential or special loss, including loss of profit, loss of opportunity or damage to reputation, except where such liability cannot be excluded by law.

13. Changes to these terms
13.1 We may update these Terms and Conditions from time to time by publishing the updated version on the Site. The revised terms apply from the date of publication.

13.2 Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms and Conditions.
